The following conditions govern the business relationships between beconart and its clients. This includes the websites, companies, and brands of the management along with their contents, including viewed offers and orders.
Contracts are accepted solely based on our terms of order, delivery, and payment. The client’s purchasing terms are expressly rejected unless they are explicitly accepted in writing on a case-by-case basis. Silence from beconart in response to transmitted contract and purchasing conditions does not constitute acceptance. Contract and purchasing terms are only binding if we have expressly confirmed them in writing.
Contradictory or differing agreements or additions, including verbal or telephone arrangements, are only binding if confirmed in writing by us.
We are entitled to engage other qualified companies directly subordinate to us, freelance artists and contractors, specialized firms, etc., to fulfill and perform our contractual obligations (e.g., construction services by subcontractors).
Our offers are always non-binding and subject to change, based on our General Terms and Conditions. Deviations are only valid if explicitly and clearly stated in writing in the offer and confirmed by us via mail or email. Verbal side agreements are not permissible.
No liability is accepted for the accuracy of technical data and other information in price lists, circulars, catalogs, and manufacturer brochures. Technical changes are reserved. Any deviations do not justify claims as long as they are reasonable for the client.
The scope of services provided by beconart and the payment due by the client, including any other conditions if required, are defined in an individual, work, or framework contract between beconart and the client/contracting party.
A contract is concluded when the client sends a signed contract copy (also permissible by email or fax in individual cases), and beconart begins service or material delivery.
Orders become binding only with our written confirmation or commencement of work. By placing the order or upon written confirmation, the client accepts these General Terms and Conditions.
They are expressly referenced in the documents and available online at https://beconart.ae/impressum-datenschutz/. We provide printed or digital versions upon request.
If the performance by beconart is delayed due to unforeseen and unavoidable circumstances such as weather, air/building component temperatures below 5°C, glazing below 12°C, rain during external work, lockdowns, operational/traffic disruptions (especially from suppliers), emergencies, force majeure, lack of site access, or site closures due to authorities, the agreed execution deadline will be extended.
Idle times or delays not caused by us must be compensated by the client at 80% per employee plus additional costs (e.g., travel, allowance) according to the service contract.
Any lower damage must be proven by the client.
Surfaces exposed to natural weathering, movement, or wear (e.g., floors or cracks) are not covered by warranty regarding bond strength, color fastness, or durability. Partial treatments of exterior surfaces may lead to a non-uniform appearance depending on weather and are at the client’s explicit request.
Performance occurs only if the construction-side conditions provided by the client are met—such as unobstructed and secure access, provision of power, water, scaffolding above 3.20m height, and parking for vehicles and machinery.
Permits (e.g., street closures, wastewater disposal) are not included in our offer and must be provided by the client. beconart can take over these duties upon request for an additional fee.
Unless otherwise stated, the provisions of the most recent version of VOB/B and VOB/C apply to measurements and billing.
Extensive work is usually reviewed weekly on-site or remotely by the client and beconart and documented in writing. For projects longer than 4 calendar weeks, partial completions are recorded in written protocols.
Upon completion, acceptance may occur in person or through written final notification.
The service is considered accepted upon written review of the final invoice.
Acceptance is based on German contract law (BGB) or VOB.
Complaints about incomplete or incorrect performance or recognizable defects must be submitted in writing without delay, at the latest 8 days after performance. Other defects must be reported in writing immediately upon discovery.
If complaints and defects are not reported in time, the performance is deemed accepted, and further claims cannot be made.
beconart reserves the right to inspect and remedy the claimed defects.
If defects are claimed for specific items, all other services continue as if no defect had been reported.
If the client remedies defects without beconart’s consent, all claims for defects against beconart are forfeited.
Material delivery occurs only upon receipt of a written order and is subject to logistical conditions.
All technical and safety guidelines in data sheets must be followed during processing.
Returned goods are not accepted.
If materials are shipped at the client’s request to a construction site or address, the risk of accidental loss or deterioration transfers to the client upon dispatch or at the latest when leaving our warehouse.
Warranty claims are valid only if the client has fulfilled their inspection and complaint obligations under § 377 HGB.
Defect claims expire 12 months after delivery.
All prices are exclusive of applicable VAT or based on § 13b UStG (reverse charge).
Payments are due within the agreed period after invoicing. Our standard term is 5 calendar days net.
Claims for delay damages remain reserved.
The client may only offset against undisputed or legally established claims.
A right of retention is only allowed if based on the same contract.
Invoice disputes must be submitted in writing within one week using an invoice review sheet.
Afterward, the invoice is considered accepted without reservation.
For new clients, we may demand full prepayment upon confirmation.
No delivery or service obligation exists before payment is received.
Partial payments are based on defined construction progress and are due weekly for projects longer than 5 calendar days.
Payments must be made to the account stated on the invoice.
If payments are late, we may suspend work after a 2-day grace period.
If the client withdraws from the contract without valid reason or the contract cannot be executed for reasons attributable to the client, beconart may demand compensation of 25% of the net order amount, notwithstanding proof of higher damages.
beconart may obtain credit reports before contract conclusion to protect against payment default and misuse.
We may share relevant personal contract data with credit agencies and base contract approval on the outcome.
In the case of non-compliance, data may also be shared.
The exclusive place of jurisdiction and fulfillment for all legal disputes directly or indirectly related to the contract is beconart’s registered office in Stuttgart.
Only German law applies. Deviations require written form to be valid—email is not sufficient.
If a clause in these GTC is or becomes invalid, the validity of the remaining provisions remains unaffected.
The parties shall replace the invalid clause with a valid one that most closely reflects the economic purpose. The same applies to any legal gaps.
